Notice - Passing of Zoning Bylaw Amendment MTu Z01-2025 Wideman

TAKE NOTICE that the Council of the Municipality of Morris-Turnberry passed by-law number 28-2025 on the 3rd day of June, 2025 under Section 34 of the Planning Act, R.S.O. 1990, as amended.

EFFECT OF WRITTEN AND ORAL SUBMISSIONS 

No formal public comments were received on this application so there was no effect on the decision, and agency comments were received in support of the application, the effect of which resulted in a decision to approve the application.

AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law amendment may be made by filing a notice of appeal with the Clerk either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Morris-Turnberry as the Approval Authority or by mail, Municipality of Morris-Turnberry, 41342 Morris Road, PO Box 310, Brussels, ON  N0G1H0, no later than 4:30pm on June 25, 2025.

The filing of an appeal after 4:30pm, in person or electronically, will be deemed to have been received the next business day. 

AMOUNT OF FEE Please refer to https://olt.gov.on.ca/fee-chart/ for appeal fee. The appeal fee can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario.  If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available form the OLT website at www.olt.gov.on.ca.

Only individuals, corporations and public bodies may appeal a Zoning by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. 

No person or public body shall be added as a party to the hearing of the appeal, unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council, or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party. 


AN EXPLANATION of the purpose and effect of the by-law, describing the lands to which the by-law applies is provided below and a Key Map showing the locations of affected lands is attached, as well as the complete by-law.

PURPOSE AND EFFECT

The purpose and effect of this amendment to the Zoning By-law includes:

  1. The purpose of this zoning by-law amendment is to rezone a portion of the subject property (approximately 3 acres) from “AG1” (General Agriculture) to “AG3” (Agriculture Commercial-Industrial). This rezoning seeks to facilitate the expansion of an existing home industry use - a farm equipment repair shop - into an agricultural service establishment. The subject property is approximately 55.5 acres in size and contains a dwelling, bank barn, and welding shop.
